Sequestration, Unsecure debt

Ms M’s story

Ms M was in a difficult situation with debts that she was unable to offer a fitting monthly repayment on, we discussed her options sensitively and came to a decision that allowed her to erase her debt through sequestration.

Ms M had in the region of £50,000 of unsecured debts which she was able to manage until a change in employment and reduction in income. Ms M solely owned her property and had a motor vehicle worth less than £3,000 in value. After a thorough review of her financial circumstances we established that she could afford £145 per month. Under a Trust Deed it was unlikely that this payment would be accepted by her creditors.

On a Debt Arrangement Scheme it would take approximately 28.7* years to repay the debts. Ms M decided to proceed with Sequestration as it would not affect her property due to the small amount of equity or motor vehicle as it was valued less than £3,000. She will therefore repay a total of £6,960 into her Sequestration.

Mrs B’s story

Mrs B had around £39,000 of unsecured debts which she was struggling to repay through her high minimum monthly payments. She signed a Trust Deed which meant she could write off unaffordable debt after the agreed period.

Mrs B had in the region of £39,000 of unsecured debts which she was struggling to repay due to the high minimum monthly repayments and with no end date in sight. The client jointly owned her property with her husband. We established that the property had negative equity and would not be at risk by entering into a Trust Deed or Sequestration.

Following a thorough review of her circumstances, Mrs B could afford to pay £260 per month to a plan. She entered into a Trust Deed and was able to write off unaffordable debt after the agreed period.

She repaid a total of £12,480 into her Trust Deed. Under a Debt Arrangement Scheme, she would have been making repayments for approximately 12.5 years*.

Mr and Mrs G’s story

Mr and Mrs G took our expert advice and entered into a solution that helped them write off unaffordable debt as they approached retirement. Here's how.

Mr & Mrs G had in the region of £28,000 of unsecured debts. They jointly owned their property and Mr G had a motor vehicle subject to finance. After reviewing their circumstances we established that the property had negative equity and as such was not at risk by entering into a Trust Deed or Sequestration.

After thoroughly reviewing their budget, they could afford to pay £400 per month towards a plan. Under a Trust Deed, they would be able to write off unaffordable debt after an agreed period of time.

Mr & Mrs G entered into a Trust Deed to enable them to use their disposable income to repay their mortgage as they approached retirement. They repaid a total of £19,200 into their Trust Deeds. Under a Debt Arrangement Scheme the plan would last for approximately 5.8* years.

My wife and I have both gone through the process of a Trust Deed and we are only waiting for the discharge to complete. What a relief!

We initially went to four debt management and insolvency companies in Scotland and sat through the painstaking process over four days. We were confronted with confusion, inexperience and no result. In particular, the threat of the loss of our family home was continually highlighted through this experience.

It is worth bearing in mind that most of the debt management companies in Scotland with high profile advertising are commission based and they are not the leading agent as they pass you to profit based insolvency companies.
